Terms of Participation
Participation in the contest by bruno banani underwear GmbH is free of charge and is exclusively governed by these terms of participation.
Contest Procedure
The duration of the entire contest extends from February 5, 2024, 00:00 (UTC) to February 19, 2024, 23:59 (UTC). Within this period, users have the opportunity to participate in the contest online.
Participation
To participate in the contest, it is necessary to post a photo of oneself on Instagram or Facebook, tag it with #brunobananimodel, tag @brunobananiofficial, and follow @brunobananiofficial on Instagram. Participation is only possible within the specified period. Registrations received after the deadline will not be considered in the draw. By posting the picture, the participant agrees that their photo may be published on the bruno banani page for the purposes of the contest. Legal recourse is excluded.
Each participant is allowed only one submitted entry in the contest. Users using multiple Instagram profiles to increase their chances of winning will be disqualified from the contest.
Participation in the contest is free of charge.
Eligibility to Participate
Eligible participants are natural persons who have their residence in Germany and have reached the age of 18. Participation is not limited to customers of the organizer and is not dependent on the purchase of goods or services.
If a participant is limited in their legal capacity, the consent of their legal representative is required.
Not eligible to participate in the contest are all persons involved in the conception and implementation of the contest and employees of bruno banani, as well as their family members. Furthermore, the operator reserves the right to exclude individuals from participation at its own discretion if there are justified reasons, such as (a) manipulation in connection with access to or conduct of the contest, (b) violations of these terms of participation, (c) unfair conduct, or (d) false or misleading information in connection with participation in the contest.
Prize, Notification, and Prize Delivery
The following prizes will be awarded:
1. Participation in a 3-day photo shooting trip by bruno banani in Austria (2 winners)
The winners will be determined after the end of the participation period through a vote on the Bruno Banani Instagram profile and a selection by a jury in the second round among all participants.
The winners of the contest will be promptly informed about the prize via a separate email. The address communicated by the winner in response to this email is considered the shipping address of the prize.
The prize will be handed over exclusively to the winner or to the legal representative of a minor winner. Exchange, self-collection, and cash payment of the prize are not possible.
Dominik Stuckmann, on behalf of bruno banani, covers the costs associated with accommodations in Austria and travel. In the case of travel by car, a mileage allowance of €0.30 per kilometer will be covered. Any additional costs associated with the use of the prize are the responsibility of the winner. The winner is personally responsible for any taxation of the prize.
If the winner does not respond after two requests within a period of 3 weeks, the prize may be transferred to another participant.
Termination of the Contest
The organizer expressly reserves the right to terminate the contest without prior notice and without stating reasons. This applies in particular to any reasons that would disrupt or prevent the planned course of the contest.
Data Protection

The organizer points out that all personal data of the participant will not be disclosed to third parties or made available for use without consent. An exception is made for companies commissioned to carry out the contest, such as DSVW Management, which must collect, store, and use the data for the purpose of conducting the contest.
In the event of winning, the winner agrees to the publication of their name and place of residence in the advertising media used by the organizer. This includes the announcement of the winner on the operator's website and its social media platforms.

This promotion is not affiliated with Facebook or Instagram and is not sponsored, endorsed, or organized by Facebook or Instagram in any way.
Applicable Law

The contest of the operator is exclusively subject to the law of the Federal Republic of Germany. Legal recourse is excluded.
Severability Clause
Should a provision of these terms of participation be or become wholly or partially invalid, this shall not affect the validity of these terms of participation in all other respects. Instead of the invalid provision, the legally permissible regulation that comes economically closest to the meaning and purpose expressed in the invalid provision shall apply. The same applies in the event of a regulatory gap in these terms of participation.
